Conditions of Participation SHIFTSNGY™ Competition

Promotion period: 15.05. – 17.05.2024

SHIFTSNGY is giving away 3 hoodies from the Wheely Collection to all participants.
The campaign is organized by SHIFTSNGY.

1. Eligibility

(a) All natural persons aged 18 years or over who are resident in Germany or Austria are eligible to participate.
(b) To participate in the promotion, the following conditions must be met must be fulfilled by 17 May 2024:

1. The participating person must follow the Instagram account @shiftsngy.
2. The participating person must like the competition post on Instagram.
3. The participating person must tag 3 people in the comments.
4. Extra ticket: by sharing the Instagram post in the story and linking to @shiftsngy the participating person receives an additional ticket.

(c) Participation in the promotion is only possible under the conditions set out in point (b).
(d) By participating in the promotion, the participant agrees to these conditions of participation.
(e) In order to process the campaign, it is absolutely necessary that the participants selected provide correct personal information. Otherwise, SHIFTSNGY is entitled to exclude the participant from the campaign and, if necessary, draw a replacement winner. SHIFTSNGY reserves the right to exclude people who gain advantages by manipulating the campaign from the campaign. In such cases, participants may also be subsequently excluded from the campaign, prizes may be revoked and/or services provided may be reclaimed.

2. Implementation

(a) The promotion runs from May 15, 2024 to May 17, 2024 (11:59 p.m.). Participants will be randomly selected in accordance with section 3 below. The winner will be announced on May 24, 2024. This notification does not constitute termination; the promotion ends solely due to the passage of time. Individuals who meet the conditions set out in point 1 (b) after May 17, 2024 (11:59 p.m.) will not participate in the prize draw.
(b) Determination of the winners:
All participants who have fulfilled the conditions under 1(b) within the deadline will be entered into a random generator. In addition, the extra tickets will be taken into account when adding the participants. The winning people will be randomly selected from all participants on May 24, 2024.
(c) The winners will be notified of their win promptly via a direct message on Instagram from @shiftsngy.
(d) The winning person must confirm receipt of the prize notification within 2 days and provide his/her full contact address (Name, address, zip code, city, telephone number, email). If the email cannot be delivered or the participant does not respond within the deadline, he or she will be excluded from further participation/winning and a new winner will be determined.
(e) The winning person agrees to the publication of his/her name on SHIFTSNGY’s social media pages in the event of participation.

3. Promotional and other prize conditions

(a) The winning person will be contacted via the Instagram account @shiftsngy after timely submission of contact details ( 2(d) ) to discuss the colour and size of the hoodie and delivery details.
(b) The claim to the prize cannot be assigned - in particular, no person other than the winner can be named as the winner by the winning person, even if he or she is prevented from doing so. Cash payment of the hoodie or any replacement is not possible under any circumstances.

4. Exclusion from the promotion

SHIFTSNGY is entitled to exclude participants from this campaign who violate the conditions of participation, provide incorrect personal information, use unfair means and/or exploit content of which they are not the author and/or violate the rights of third parties, such as their rights of use or personal rights.

6. Privacy Policy

By submitting your personal data, you agree to the storage and processing of this data for the purpose of processing the campaign. If you have also given your consent for your data to be used for advertising and customer advice, SHIFTSNGY can inform you about products. Your data will not be used outside of the campaign. You can revoke your consent at any time for the future. 7. Limitation of Liability

(a) SHIFTSNGY is liable in accordance with the statutory provisions for intent and gross negligence on the part of SHIFTSNGY, its legal representatives or vicarious agents, as well as for culpable breach of essential contractual obligations. In the case of only slightly negligent breach of essential contractual obligations, liability is limited to compensation for damage typical of the contract that was foreseeable at the time the website was used. This limitation of liability does not apply to damage caused by SHIFTSNGY, its legal representatives or vicarious agents resulting from injury to life, body or health, or for liability under the Product Liability Act.
(b) The above limitation of liability applies in particular to damages caused by errors, delays or interruptions in the transmission of data or similar, malfunctions of the technical systems or services, incorrect content, loss or deletion of data, viruses.

8. Early termination

SHIFTSNGY reserves the right to cancel the competition at any time without prior notice if there is an important reason. An important reason may arise for technical reasons, such as viruses in the computer system, manipulation or errors in the application or for legal reasons.

9. Miscellaneous

(a) The law of the Federal Republic of Germany shall apply.
(b) Legal recourse is excluded.
(c) Should any of these provisions be or become invalid, the validity of the remaining provisions shall remain unaffected.
